1. Consider a Resolution by the City Council authorizing the Director of the Planning, Building and Zoning Department to issue a letter of release for a Subdivision Improvements Performance Bond in the amount of seven thousand dollars for the installation of sidewalk along Main Street, for the Kenai Townhome Development

SUMMARY AND BACKGROUND: This resolution by the City Council authorizes the Director of Planning, Building and Zoning Department to issue a letter of release for a subdivision improvements performance bond in the amount of seven-thousand dollars ($7,000.00) for the installation of sidewalk along Main Street, for the Kenai Townhome development.

Kenai Townhomes, a fifty-six (56) lot / unit development located at 380 Main Street, has recently been obtained by Magnet Bank a Utah commercial bank from McNair Grading, Inc. through foreclosure. McNair Grading Inc. defaulted on a $1,901,501.00 loan debt and Magnet Bank secured the property for $1,700,000.00. McNair Grading, Inc. has constructed the civil site work to include potable water system, sanitary sewer system, storm water system, curb and gutter and roadways; all have been inspected and approved. The 1,400 lf of sidewalk has not been constructed to date, as a result of the foreclosure. A representative of McNair Grading Inc. has contacted the Planning, Building and Zoning Department seeking a letter of release for a seven-thousand dollar ($7,000.00) performance bond for the construction of 1,400 lf of sidewalk along the Main Street frontage of the Kenai Townhome development. McNair Grading, Inc. no longer has any ownership or control over the development as a result of the August 5^th, 2008 foreclosure.

At such time as a new developer/contractor applies to secure the necessary and required permits to continue the project, a performance bond for the installation/construction of the 1,400 lf of 5’-0” sidewalk (Ga. DOT Standard 9031w) along the Main Street frontage of Kenai Townhome development will be obtained from the contractor prior to the issuance of a building permit.

2. Consider a Resolution by the City Council of the City of

Forest Park declaring certain City property, listed on Exhibit A, to be surplus property and to provide for its proper disposal either by auction or other methods pursuant to the City’s Ordinances; and for other purposes

3. Consider an Ordinance by the Mayor and Council for the City

of Forest Park, Georgia, to impose a temporary moratorium within the City for up to 180 days on the acceptance of applications for the permitting of, and on the permitting of towers, as defined herein and in the City Code of Ordinances, including but not limited to radio and television transmission towers, microwave towers, cellular telephone towers, alternative tower structures, and other similar devices and structures; to provide for the purposes of the moratorium, to provide for findings of fact, to provide for the imposition of the moratorium and for the duration of the moratorium for up to one hundred eighty (180) days; to provide for the consideration of permit applications already filed as of the effective date of this moratorium; to provide for severability; to provide an effective date; to repeal all ordinances and parts of ordinances in conflict herewith to the extent of such conflict; and for other purposes
