REGULAR MEETING OF MAYOR AND COUNCIL OF APRIL 19, 2010

 

 

 

 

 

Call to Order:               The Regular Meeting of Mayor and Council of April 19, 2010,                                      was called to order by Mayor Corine Deyton at 7:00 p.m.

 

Invocation:                    The invocation was given by Councilwoman Karen-Brandee Williams followed by the Pledge of Allegiance to the American Flag.

 

Roll Call:                      Mayor Corine Deyton, Mayor Pro-tem Sparkle Adams, Councilman Donald Judson and Councilwomen Linda Lord, Maudie McCord and Karen-Brandee Williams.

 

                                    Also present were City Manager John Parker, Director of Finance Mike Blandenburg, Director of Planning, Building and Zoning Steve Pearson, Management Analyst Angela Redding, Deputy Director of Public Works Rusty Still, Major Chris Matson, Director of Support Services Christine Terrell, Chief Eddie Buckholts and City Attorney Robert Mack.

 

Approval of minutes:     Mr. Judson made a motion to approve the minutes of the Work Session of Mayor and Council of April 5, 2010 and the Regular Meeting of April 5, 2010, seconded by Ms. Lord.  Voting for the motion was unanimous.

 

Comment Period:          Mr. Roy Lunsford spoke.  He stated at the corner of 19/41 and Forest Parkway on the northside of the intersection, there are holes in the right hand lane that need to be patched.

 

                                    Ms. Christine Ellington spoke.  She brought up an issue involving fencing.  She stated she understood there is a 4/8 ordinance, which means nothing in front should be over 4 feet high and the sides and back over 8.  There is clearly a violation at 658 Linda Way.  She stated she was told there was no such ordinance.  She stated she has never seen anyone put up a wooden fence in the front of their property and think that is ok.  She stated we also have trees, overhang, must be trimmed and clear which is surely a violation.  She stated if the City needs money, she would recommend giving these people a violation, a fine, a clear fine.  We do it when we are giving out tickets here, lets give out some violations.  If we are violating ordinances, we should do the same here.  They need to enforce this ordinance. 

 

                                    Mr. Harold Crumbley spoke.  He stated he is a member of the Forest Park Methodist Church and they have been approached to place a tower on back of their property, which would bring in $1,000 a month.   He stated he understands their property is zoned residential and it is not allowed, and the zoning will have to be changed.  He asked the Council consideration when this request comes before them.

 

                                    Ms. Bailey spoke.  She stated she would like to commend Mr. Parker and the City for doing the work at the Macedonia Rocksprings Cemetery.  The City did a beautiful job and she also thanked Ms. Adams.  She stated they are organizing to make sure they keep the cemetery clean.

 

                                    Rev. Robert Melson, Pastor Dodd Sterling United Methodist Church spoke.  He stated the City has helped us preserve a piece of history that is unique to us and very precious to us.  Because of the efforts of Mr. Parker and Ms. Adams, we now have a cemetery we can look at and say that’s our cemetery.  It is clean and beautiful.  He said we are raising money for the perpetual care of the cemetery along with a fence. 

 

                                    Mr. Willie Finch spoke.  He stated his daughter lives at 670 Shelnutt Drive and has a private fence.  This fence was sprayed with graffiti and she has not been able to get it off.  She stated Code Enforcement gave her a ticket for it, but she can’t get the graffiti off.  He stated she has a lot of money in that fence and does not want it ruined. 

 

                                    Mr. Parker stated we have comments given during our meetings and you do not hear the answer to any of these.  He stated we do take them seriously and look into each item brought up.  He stated he wants to let everyone know that each meeting when comments come up, they will be addressed at the next regular meeting.

 

                                    Mr. Rusty Still, Deputy Director of Public Works, commented on the remarks made by Mr. Roy Lunsford at the last council meeting concerning Unit 118 riding up and down Ash Street doing nothing.  He stated that Unit was working on the south side of town and was dispatched from his duties to pick up a large dead dog somewhere on Ash Street.  He traveled Ash Street three times trying to locate the dog, but was not found.

 

                                    Mr. Steve Pearson commented on the complaints made by Ms. Ellington at the last council meeting.   He stated Code Enforcement checked into her complaints and stated 933 Kennesaw Place is actually 893 Kennesaw Place; 3 properties were involved there.  On April 12th, property was inspected and found to have open storage of debris, lumber parts, trees and limbs in the yard area.   Next door, at 883 Kennesaw Place had a refrigerator under the carport and an accumulation of trash and debris. Also at 892 Kennesaw Drive, the property was inspected and found to have appliances in the front yard and under the carport, along with an inoperable vehicle.  All three property owners were given a 5 day notice to comply with a compliance date of April 17th. As of today, 883 Kennesaw Place and 892 Kennesaw Place did not comply and received citations to appear in Environmental Court on May 28th for disposition.  893 Kennesaw Place was brought into compliance.  At 5209 Austin Place, upon inspection, it was determined this location did not have any code violations.  He stated upon inspector of the neighbors six foot privacy fence allegedly blocking the view of Linda Way, it was determined that the view and site distance of traffic on Linda Way while exiting the driveway at 650 Linda Way was not obstructed by the neighbors privacy fence.  He stated in fact the fence is set back off the right of way a distance of 8 ft. 6 in. and is in compliance with city code.

 

Swearing In -                Mayor Pro-tem Sparkle Adams swore in the Teen Council

Teen Council:               Members.      

 

Proclamation:                Mayor Pro-tem Sparkle Adams presented Ms. Marybeth Leavell with a proclamation for her work with the Forest Park Street School and Prevention Plus.

 

Adjournment:                Ms. McCord made a motion to adjourn, seconded by Ms. Lord.  Voting for the motion was unanimous.

 

                                    The meeting adjourned at 7:45 p.m.
